Worldwide: Data Privacy Landscape

In August this year, India replaced its set of data security rules with a new Digital Personal Data Protection Act, 2023 (“DPDP”). The regulatory framework governing data protection in India was archaic, with laws primarily outlining basic data security requirements. 

In a rapidly changing digital economy, the DPDP has been positioned to fill a vital gap in the data protection regime in India. The DPDP calls for compliance in the collection and processing of personal data, towards specific lawful purposes. Data Fiduciaries, who determine ‘the purpose and means of processing of personal data’, have been tasked with several obligations towards protecting individuals’ personal data, failing which would risk steep penalties. The obligations also extend towards the protection of processing of children’s data and the prevention of behavioural tracking and targeted advertising. The Act also has extra-territorial application, and allows the Government the power to restrict cross-border transfers by way of notification. 

Although much is left to be seen with the eventual introduction of rules and regulations, the Act in its present state could lead to some interesting repercussions for Indian and foreign businesses.

Vikram Jeet Singh

Vikram is a Partner in BTG Advaya’s New Delhi offices, heading their Tech, Media, and Comms (TMC) practice group. He has almost 20 years of experience in advising Indian and overseas clients on complex issues relating to digital business, data privacy, platform liability, and online selling. 

Vikram’s areas of expertise include advising on data protection and privacy regulations, cybersecurity, Internet intermediary regulations, online content, payments and fintech, and online advertising matters. As part of his data privacy practice, he has advised clients on adequacy assessments for cross borders data transfers into India, and data access requests from Indian regulators.

Ayan Sharma

Ayan Sharma leads the Policy and Advocacy in the Technology, Media, and Communications practice group at BTG Advaya. Ayan has worked and engaged in extensive advisory and legislative drafting for several central government ministries specifically in the field of Information Communication Technologies and digital markets. His advisory work extends to leading domestic and international content platforms, online gaming entities, online travel aggregators, and social media platforms on regulatory and policy matters.

In his previous role, he has contributed to policy development and engagements with African governments, specifically Rwanda and Morocco, in climate finance and technology sectors.

Flemming Moos

Dr Flemming Moos is specialised in data protection and IT law and has spent many years advising national and international companies from the technology industry as well as their customers.

Flemming advises his clients on the entire range of data protection law. He also focuses on designing and negotiating all kinds of contracts related to data protection. He is also regularly involved in outsourcing projects, large IT projects and IT law disputes.

Gauri Manglik

Gauri is a senior business attorney based in Menlo Park, CA, with a strong background in providing strategic legal and privacy counsel to technology companies. She is currently the Deputy General Counsel, Privacy and Product at GoFundMe.

Her experience spans various roles, including serving as General Counsel and Chief Privacy Officer at Clearbit, where she established trust with leadership, reduced outside legal spending, managed board matters, and enhanced sales and commercial legal support. At Aura, she served as Deputy General Counsel, contributing to corporate governance, financing, mergers and acquisitions, and streamlining contracting processes. While at SoftBank, Gauri led its AI Task Force, advised on corporate transactions, managed commercial contracts, handled employment matters, and provided counsel on intellectual property and CFIUS compliance. She also founded and led KitaabWorld.com, a mission-driven e-commerce startup.

Gauri's educational background includes an LLM from UCLA School of Law and a B.A. LL.B from the National Law School of India University. She is CIPP-US Qualified and licensed to practice law in California and India, with a notable publication record and active involvement in non-profit boards, demonstrating her commitment to the legal profession and community.
