FMLA's Expanded Definition Of "Spouse" Now Effective In All States

In March 2015, Texas, Arkansas, Louisiana and Nebraska succeeded
in enjoining enforcement of a recent Department of Labor rule that
extended federal Family and Medical Leave Act (FMLA) protections to
same-sex spouses whose marriages were valid in the states in which
they were celebrated. In light of the U.S. Supreme Court's June
26, 2015 decision in Obergefell v. Hodges, the U.S.
District Court for the Northern District of Texas dissolved this
injunction, in effect requiring these states to extend equal
marriage protections to same-sex couples.
