United States: Rapid Workplace Transformation in the Wake of COVID-19

Global digital transformation of the workplace was already well underway before COVID-19 was in our vocabulary, and long before social distancing became an expected societal behavior. However, the pandemic has massively accelerated the pace of transformation. In this presentation, we will canvas the labor and employment law considerations you must account for as your business embraces initiatives that take advantage of digital transformation. We will examine workplace transformation end-to-end, from the key questions you must ask in deploying AI-powered tools to aid in recruiting, to the labor and employment laws you must account for when workplace transformation leads to worker displacement. We will also discuss strategies for reskilling and upskilling your workforce so that your business will continue to thrive as the economy transforms.

Michael Lotito

As co-chair of Littler’s Workplace Policy Institute (WPI), Michael Lotito strategically advises clients and policy makers on what labor and employment law might become, not just what it is today. Through the Emma Coalition, a project Michael co-founded and named in honor of his granddaughter, he is at the vanguard in preparing the American workplace for the future of work. As technology, especially robotics and artificial intelligence, creates not only unprecedented displacement but also unprecedented opportunities, the Emma Coalition examines what skills the American workforce will need down the road to remain competitive in the years to come.

Michael Chichester, Jr.

Michael Chichester is an experienced employment litigator and advisor who frequently collaborates with his colleagues to provide clients with practical solutions. As Co-Chair of Littler's Robotics, Artificial Intelligence and Automation Practice, Mickey Chichester has developed a deep understanding of the labor and employment law challenges employers will face as the workplace transforms. Since being named Co-Chair of that practice, Mickey has worked with co-chair Garry Mathiason to develop a cross-disciplinary team of subject matter experts who can bring their collective expertise to bear as employers embrace digital transformation and the novel legal issues that coincide with such transformation.

Britney N. Torres

Britney Torres is an experienced litigator and advisor for employers of all sizes on all aspects of the employer-employee relationship. In addition, Britney counsels organizations regarding diversity and inclusion considerations – from preliminary consultation and assessment through development of targeted, long-term initiatives. Britney is currently a member of the firm’s Innovation Advisory Council, which is tasked with reengineering the traditional practice of law to bring clients cost-effective and forward-thinking solutions that employ leading-edge technology, project management skills, and alternative pricing strategies. She also served on the firm’s Diversity and Inclusion Council and continues to be involved in internal diversity and inclusion initiatives.
