Worldwide: Data Privacy Compliance in China: A Time to Act

China has built an extensive legal framework to deal with data privacy issues. A key focus this past year has been on outbound data compliance; some of the key challenges for international businesses in this area include:

- With GDPR as model, The new system has distinct Chinese characteristics that make it challenging to understand and adapt to.

- The system is still under development.

- While the main targets are large-scale handles of personal information, the law put obligations on almost all international companies operating in China.

Many international companies are taking a wait-and-see attitude. But deadlines are fast-approaching or have already passed, and in the current environment, multinationals are the prime targets of government enforcement actions. International companies must understand their duties and review the steps necessary to become compliant.

In this webinar, we will target two kinds of companies:

1. International operators that handle large volumes of personal information, whether established in China or based outside China; these may have to complete security filings with the CAC. The deadline for these filings were in Q1, but statistics show that many are lagging behind. 

2. International companies that handle only limited personal information, but may still fall under the PIPL framework because they are handling and exporting personal information abroad. The 6-months period for compliances ends in Q4.

For each of the above groups of companies, we will be discussing the following:

o Which companies fall into each of these groups.
o What actions do these companies need to take to be / remain compliant
o What are some of the key challenges for these companies in trying to remain compliant (using real examples from clients / cases)
o What are the key enforcement risks that we see in the next 6-12 months (based on practical examples in the field)

SPEAKERS
Maarten Roos

From the Netherlands, Maarten has been in China since 1999. He has over 20 years of experience in the Chinese legal industry, and his firm R&P is one of China’s primary boutiques for international companies. Asialaw Leading Lawyers, Chambers and Legal500 have recognized Maarten as a pre-eminent practitioner in China.

Maarten’s clients include companies listed in Europe or the United States; large privately-owned enterprises; and small- to medium-sized companies. His clients operate in retail, manufacturing, healthcare, agriculture & horticulture, entertainment, trading and services. He supports them on corporate and commercial projects; regulatory, compliance and data privacy; and employment law.

Connie Chen

Connie started her career in the Chinese judicial system, as a labor arbitrator judging labor disputes in Guangzhou. She then practices at leading domestic and international law firms before moving in-house, first at Italian chocolate company Ferrero and then at US apparel brand GAP.

Connie's focus is on privacy and data protection, cyber security, and regulatory matters, and she mainly supports international clients on data security inspections and assessments, establishing data compliance system, filings with the Cybersecurity Administration (CAC) and dealing with government inspections.

Alice Peng

Alice’s career path is unique. She started her as a Chinese prosecutor, but after four years joined a leading domestic law firm in dispute resolution. She then moved to a Magic Circle firm focusing on compliance, and then continued her career as global compliance director of a global pharmaceutical company. She then joined R&P as partner in 2020.

Alice supports multinationals on internal and external compliance investigations and represents them in administrative and criminal enforcement actions. She also helps her clients to build effective compliance systems, and provides trainings on compliance, dealing with government authorities, and dispute resolution in China.
