Worldwide: Spanish Tax Regime Amendments for Inpatriates: New Eligibility Criteria

A tax policy shift has taken place in Spain. The Spanish preferential tax regime for inpatriates was introduced in 2004, to boost the competitiveness of Spanish MNEs by helping them attract foreign talent through significant tax advantages for employees and executives.

The regime was not, until now, available for business owners, capital investors, digital nomads or successful self-employed individuals. The improved regime is now on a level playing field with its Portuguese, Italian, Swiss and English counterparts.

In our presentation, besides providing an outline of the regulations, who will follow a case study format to provide you with an overview of how different types of taxpayers would be taxed under the improved regime depending on their circumstances, and of course cover borderline cases.

Alvaro Checa

Álvaro is co-founder of Kinship and Partner specialising in International Taxation and Private Clients. He has extensive previous experience from his work in prestigious international firms. 

Pedro Fernandez

Pedro is co-founder and Managing Partner of Kinship. Coming from an international law firm, he has 30 years of experience in the world of law, with a special focus on international taxation.

He is also specialised in providing legal and tax advice to foreign families and companies that move to Spain to set up residence, work or start a business.  

Regis Molowny

Regis is a Vice President within the Goldman Sachs Family Office Wealth Strategy team in Private Wealth Management, based in Madrid. He provides wealth structuring services to clients and assists family-run companies and wealthy individuals with succession planning and with structuring their private and corporate assets in an effective way, with a special focus on private equity structuring, family offices and investment funds. Regis started his career at one of Spain's largest law firms, cuatrecasas, where he was a tax specialist for Financial Institutions and M&A transactions. In 2008 he joined Merill Lynch as Head of Wealth Structuring for Spain, and in 2012 he joined J.P. Morgan as Head of Wealth Advisory and Life Insurance Mediation in Spain. In addition to his degree in Law (1996), he completed his studies with a Master in International Tax by the instituto de Empresa (IE).
