Europe: International Personal Data Transfers from the European Region: Practical Approaches for Compliant Transfers from EU, Switzerland and UK

Recent developments in Europe in the area of ex-EU data transfers pose significant challenges for companies operating internationally. The new EU Standard Contractual Clauses (SCCs) and the EDPB Recommendations, which require data exporters and importers to conduct comprehensive assessments on the impact of data transfers, set new standards for companies.

At the same time, companies transferring personal data from Switzerland or the UK must also consider the corresponding regulations under Swiss and UK law, which in some cases differ from EU standards and cause a considerable amount of additional work in practice. 

In this webinar, we will: 
- Recap the recent developments in the EU, Switzerland and the UK regarding international data transfers, highlight the applicable requirements and explore their implications for companies operating internationally;  
- Outline the steps data exporters and data importers need to take before transferring personal data to a third country;
- Share experiences and practical tips on conducting transfer impact assessments (TIAs), when and how to conduct them, and explain the role and responsibilities of data importers (from a US perspective); and
- Explain the transfer tools available for personal data transfers from the EU, Switzerland, and the UK, and how to deal with global contracts (including intra-group data transfer agreements) and BCRs.

SPEAKERS
Daniela Fabian

Daniela Fabian Masoch is the founder and executive director of FABIAN PRIVACY LEGAL, a boutique law firm specialized in international, European and Swiss data protection law, governance, risk management and program implementation. Daniela is a Swiss attorney-at-law, certified Privacy Professional and ISMS 27001 Lead Auditor with 30 years of professional experience, including as Global Head Data Privacy at Novartis for many years. She advises multinational companies in the EU, Switzerland and the USA, on data protection and security issues.
Daniela is a member of various data protection associations, and a frequent speaker and lecturer on data protection and digital marketing. 

Dan Goldstein

Dan is the co-founder of Tueoris, LLC, a US-based privacy and data security consultancy serving clients internationally.  He advises clients operating in complex business and regulatory environments on privacy and data risk mitigation strategies and solutions.  Dan has extensive global experience helping clients develop and implement enterprise privacy programs.  Prior to founding Tueoris, Dan was the Director of International Data Privacy for Amgen (Europe) GmbH in Zug, Switzerland.  He is a member of the State Bar of California, a Certified Information Systems Security Professional (CISSP) and a Certified Information Privacy Professional (CIPP – US and European certifications).

Nick Tyler

Nick Tyler is Regional Privacy Lead & Counsel for Takeda Pharmaceuticals. Nick has worked for Takeda since January 2013, in both Regional and Global Privacy roles. In his current role Nick is responsible for leading Privacy Office support to Takeda’s Commercial business across Europe, Middle East & Africa as well as throughout the Asia-Pacific region. He also provides strategic advice and support to Takeda’s Global HR Function.
Nick has significant expertise and experience dealing with data protection and privacy issues in the life sciences industry, both in-house and in private practice.
Previously, Nick worked at the Information Commissioner’s Office (ICO), the UK’s data privacy regulator, where he was the Commissioner’s Legal Adviser.
