Ireland: The Changing Employment and Pensions Landscape in Ireland: Recent and Upcoming Developments

The events of 2020 led to many changes to employment law and practice in Ireland and 2021 continues (and accelerates!) this trend. Employers now face new decisions, new responsibilities and new obligations. We will examine these recent changes to workplace practices, including the right to disconnect, flexible/remote working and working with COVID-19. We will also examine key upcoming developments such as the right to request flexible working, statutory sick pay, changes to whistleblowing legislation and gender pay gap reporting.

In addition, we will look at how pension scheme trustees and employers can comply with IORP II now that it has arrived in Ireland. We will discuss the key points of concern which pension scheme trustees and sponsoring employers will need to be aware of and start complying with. This includes trustee and key function holders fitness and probity, the new system of governance and new supervisory powers of the Pensions Authority.

SPEAKERS
Catherine O'Flynn

Catherine is Head of William Fry’s Employment & Benefits team and the current Chair of the Law Soceity of Ireland's Employment and Equality Law Committee.  Catherine has significant experience advising clients in relation to confidentiality, restrictive covenants and severance related matters.  Catherine has acted on behalf of a wide range of commercial clients and also regularly advises senior level executives.

Ciara McLoughlin

Ciara McLoughlin is a Senior Associate in the Employment and Pensions team. She has a wealth of experience advising trustees and employers on pensions aspects of corporate M&A transactions, carrying out due diligence and advising on potential issues and solutions where pension liabilities may arise.  She advises on the day-to-day management and administration of schemes including: scheme documentation amendments and benefit design, funding arrangements, liability management exercises such as buy-ins, winding up of schemes, GDPR implementation and pension disputes.  She is a Council Member of the APLI and the UK APL and has an understanding of UK pensions law. 

Richard Smith

Richard is an Associate in our Employment & Benefits Department having worked in William Fry for over two years before qualifying in 2018. Richard has experience advising clients on a wide range of employment and immigration law issues, including advising on employee contracts and terminations, employment permit applications, working time legislation, protective leave, and grievance and disciplinary proceedings.

Eimear O'Leary

Eimear is an Associate in our Employment & Benefits team. Eimear holds a BBL qualification from University College Dublin. Eimear has experience in both contentious and non-contentious employment law matters, including advising on employment aspects of M&A transactions, employee contracts and terminations and advising on a wide range of employment disputes.
