Worldwide: Luther Reset Series: Recent International Trends in Human Rights and Environmental Disputes

Claims against big corporations based on international law, whether connected to climate change and environmental matters or human rights violations by suppliers, are on the rise (e.g. climate change claim of a Peruvian farmer against RWE; Congolese child cobalt mining lawsuit against major US tech companies). In addition, some legislators have introduced different degrees of legal responsibility for compliance with international human rights law in the supply chain. The panel members will discuss the impact of these recent trends on international businesses and the chances resulting from it.

SPEAKERS
Richard Happ

Richard Happ advises and represents both companies and states in complex litigation and arbitration proceedings. He specializes in arbitration proceedings where a government is involved, in particular, investment arbitration proceedings, and in arbitration proceedings in the energy sector. Richard Happ already acted as an advisor in disputes arising from gas storage and supply contracts, the sale of gas networks, claims for compensation under energy law, the construction of power plants, investments in wind power plants and solar plants, long-term supply and purchase right contracts, and disputes in connection with nuclear power plants. The relevant arbitration proceedings were conducted in accordance with the applicable international rules (DIS, ICC, ICSID, SCC, UNCITRAL) in Frankfurt (Germany), Paris (France), Stockholm (Sweden), Geneva (Switzerland) und Washington, D.C. (USA). He is also regularly appointed as an arbitrator in disputes arising out of joint ventures and M&A transactions (post M&A disputes).

Simon Hotte

Simon Hotte is a partner and Director of the Economic law department. Having joined FIDAL in 2006, Simon has been a partner since 2011.

He has over 15 years of experience practicing in the following areas: Business contracts (advisory and litigation): sales/purchases, distribution, logistics, complex industrial and subcontracting arrangements. Price transparency: assistance in commercial negotiations, invoice audits and related disputes. Antitrust: unfair trade practices and restrictive practices. Antitrust audits and compliance programs. Assistance in the context of DGCCRF or antitrust inquiries (European Commission, French Competition Authority) and antitrust litigation. Complex contractual transactions: purchase alliances, technology transfers, consortiums. Litigation: issues relating to conformity, warranties, abrupt termination, contractual liability, product defects and related expert appraisals, before national courts and arbitration tribunals.

Robyn Buck

Robyn Buck is Senior Assistant General Counsel for Litigation at Bayer, where she has been in the law group (previously with Monsanto Company) since 2016.  Prior to joining Bayer, she was a litigation partner in the mass tort and products liability group at Husch Blackwell in St. Louis, Missouri, where she practiced complex litigation for 15 years.

James Hoskin

James Hosking has been practicing in the international disputes arena for over 25 years. Prior to co-founding international dispute resolution boutique Chaffetz Lindsey, he was a partner in Clifford Chance’s New York office and previously practiced in New Zealand. James’ practice focuses on international commercial and investment arbitration, both as counsel and arbitrator. His recent contributions to arbitration scholarship include the 2nd edition of the leading commentary on the ICDR International Rules, the forthcoming ICCA “Right to a Hearing” project, and as an Adjunct Professor at NYU School of Law.  Who’s Who recognizes James as a Global Elite Thought Leader.

Jukka Weigel

German-qualified lawyer and Senior Legal Counsel in the Corporate Legal Department of BASF SE in Ludwigshafen/Germany. Besides CSR, mainly focusing on Corporate Law, M&A and Commercial Law.

Borbála Dux-Wenzel

Borbála Dux primarily deals with class actions, large individual proceedings, and international arbitration proceedings. This particularly includes representing her clients in court and managing class actions on the part of the defendant in the areas of product liability, antitrust damages, capital investment and insurance law.
