United States: Activist Groups, Congress, and Government Investigations: 3 Threats for Consumer Protection Lawsuits

Food ingredients. Safety Claims. Environmental Sustainability. As activist groups increasingly target business practices and advertising claims, it is critical for companies to understand the new landscape in which they are operating. Activist groups are pushing the U.S. Congress to investigate and issue reports that are encouraging more investigation and, sometimes, litigation. Defendants in these litigations are increasingly broad, including companies that are not directly involved with the issue under investigation. In this webinar, we will discuss the growing interplay between the government and litigation. We will also explore how companies can best address multi-jurisdictional litigation and provide strategies for managing a litigation that could rapidly expand.

SPEAKERS
Christopher Cole

Christopher Cole is the co-chair of Crowell & Moring's Advertising & Media Group. He focuses on false advertising litigation, unfair competition, reputation, brand disparagement, and intellectual property. He is an experienced litigator, handling Lanham Act and consumer class action cases, and defending against Federal Trade Commission (FTC) enforcement and related investigations. Chris also has a varied and active counseling practice, which includes advertising claims substantiation, product testing and consumer research, and consumer protection regulatory due diligence in transactions. He provides strategic and risk management guidance to some of the world's leading companies. 

James Flood

Jim Flood is the chair of Crowell & Moring's Government Affairs Group. He provides advice and counsel, builds legislative and policy strategies, assembles and leads teams and coalitions and represents corporate, association and trade group clients before the White House, Congress and federal agencies.  Jim is a former Counsel to U.S. Senate Minority Leader Charles E. Schumer (D-NY), a former U.S. Department of Justice federal prosecutor, a former outside General Counsel to national trade groups, including the American Wind Energy Association and the Advanced Biofuels Association, and the former head of Government Affairs for a publicly traded company. 

Holly Melton

Holly Melton is vice-chair of Crowell & Moring’s Advertising and Media Group. Holly focuses on counseling advertising, marketing, and consumer goods and services companies in investigations and enforcement matters initiated by the Federal Trade Commission, state attorneys general, and local law enforcement agencies. She also represents clients in initiating and defending against competitive challenges to advertising and marketing practices before the National Advertising Division of the Council of Better Business Bureaus, and in federal court. In addition, her practice focuses on counseling clients regarding claim substantiation, necessary disclaimers, and compliance with applicable laws, including Section 5 of the FTC Act, the Restore Online Shoppers' Confidence Act (ROSCA), the Telemarketing.
