United States: Cyber Insurance for a Hackable World: The Latest in Coverages, Litigation and Opportunities for Settlement

Insurance for cyber and privacy threats has become a critical component of every company’s risk management program.  The risk of cyber-related losses is substantial and ever-changing, but coverages are not standard and evolve rapidly to respond to new market dynamics.  It is important to understand the contours of potential cyber coverage under traditional and more recent cyber policy forms.  These coverages’ impact on litigation and opportunities for settlement of claims are key issues for consideration. In this session, participants will learn:

  • …key concepts about cyber and privacy coverage and how these coverages fit with traditional forms of insurance, as well as basics about cyber and privacy risks;
  • …issues to watch with respect to policy wording, including important exclusions, coverage for regulatory oversight, control of defense and coverage for BIPA (Biometric Information Privacy Act (Illinois)) claims; and,

SPEAKERS
Steven Gilford

Steven R. Gilford, Esq. is a JAMS mediator/arbitrator focused on commercial and insurance disputes nationally and in the London and Bermuda markets. He joined JAMS following 40 years of private practice in litigation, insurance and negotiation of complex settlements. Co-author of "Insurance Coverage for Data Breaches, Cyber Crime, and Unauthorized Privacy Disclosures" (PLI's Proskauer on Privacy), Mr. Gilford has been described by Chambers as having “a remarkable ability to focus on points that really matter.” His career has encompassed a range of disputes, including all aspects of insurance, major contract, private equity, technology and commercial disputes, BIPA, and consumer and other class actions.

Andrew Nadolna

Andrew S. Nadolna, Esq. is a JAMS mediator/arbitrator based in New York with a national practice focused on complex insurance matters. He utilizes his deep in-house experience to resolve a wide variety of claims with particular emphasis on coverage disputes. His recent work includes successful settlements in the areas of cyber, commercial property, D&O, E&O, employment practices, pollution, media, general commercial liability and excess and reinsurance policies.  Before joining JAMS in 2016, Mr. Nadolna held a variety of senior management positions at AIG. Prior to going in house, he was a lawyer in private practice in Chicago.

Jodi Hatherly

Jodi Hatherly is a Director in BDO’s Forensic Insurance Recovery Practice with more than 26 years of insurance claims, litigation support, and other economic damage consulting experience. Her experience includes providing business interruption, property damage, construction contract/builder’s risk, fidelity/employee dishonesty, cyber/data breach, environmental, third party liability, and insurable value related services including the quantification of damages and expert reports in support of litigation. Ms. Hatherly has experience in the energy industry including natural gas companies, refineries, pipelines, terminals, chemical/petrochemical, and electrical generation. She has experience working with the metals industry, retail chains, automotive, manufacturing, mining, health care, hospitality, higher education, and construction industries.

Bridget Quinn Choi

Bridget Quinn Choi is a cyber insurance claims professional and incident response consultant with extensive experience in guiding policyholders through immediate and comprehensive responses to data breaches and network intrusions. Based in New York, Choi ensures that Booz Allen Hamilton’s (BAH) response services are closely aligned with the needs of clients, their insurance carriers and breach coaches. Choi has been involved in implementing departmental standards and procedures related to the handling of cyber incident responses, including the creation of protocols for operations, coverage communications and claims handling guidelines. Before joining BAH, Choi served as General Counsel at Kivu Consulting, and as claims counsel at various major insurance companies.
