Governor Schwarzenegger issued Executive Order S-2-03 pertaining to state agency regulations on November 17, 2003, his first day in office. The Order instructed the Director of OAL to appoint an advisory body to recommend improvements in the rule-making process.

Bill Gausewitz, appointed by Schwarzenegger as Director, named five advisors: Anita Scuri, Department of Consumer Affairs attorney; Barry Broad, lawyer and lobbyist for labor unions; Tim Flanigan, The Flanigan Law Firm; Fred Keeley, former state legislator and former Executive Director of the Planning and Conservation League; and Gene Livingston, Livingston & Mattesich Law Corporation. Gausewitz designated Livingston to chair the advisory body.

The advisory body has reviewed several APA issues, recommending statutory language to restore OAL’s ability to make determinations on underground regulations. Soon, the advisory body will be soliciting ideas for other improvements from the general public by a notice to be published in the California Notice Register.
