NFA reminded any person with an exclusion/exemption from CPO or CTA registration to affirm the related notice of exemption by February 29, 2020.

NFA stated that current active exemptions from CPO or CTA registration that are not affirmed in a timely manner will be withdrawn on March 1, 2020. Additionally, withdrawal of exemption will result in (i) registered CPOs or CTAs being subject to CFTC Rule Part 4 requirements and (ii) non-registrants being subject to potential CFTC enforcement actions.

NFA further advised that any person or entity claiming an exemption can complete the affirmation process through the NFA Exemption System at the NFA Electronic Filings tab on its website.
