The Mozambique Intellectual Property Institute (IPI) recently published a notice clarifying provisions relating to substantive examination of patent applications which were introduced in Article 69 of the new IP Code, which came into force on 31 March 2016.

The notice issued by the IPI states that with effect from 15 May 2020, it is necessary to file a formal request for substantive examination and attend to payment of the fee for examination within 36 months from the priority date, or, where no priority is claimed, from the Mozambique filing date.

Failure to file the request for examination within the specified period will lead to lapsing of the application.
