We are pleased to announce that the Firm obtained a significant victory for one of its bank clients against a former employee that claimed they were due unpaid overtime wages under both federal and state law. The former employee, a mortgage loan originator, challenged the bank's compensation structure. With far reaching implications, the court dismissed the claim on summary judgment finding that the bank's method of calculating commissions satisfied minimum and overtime wage requirements. This case was handled in collaboration between our Litigation and Labor and Employment Law practice groups and led by Gary Franklin and Alexandra Clauss.
