Morrison Mahoney partner John Flahive obtained a defense verdict in a five-day medical malpractice trial at the Worcester County Superior Court. The plaintiffs alleged our client, an OB/GYN, negligently performed a total abdominal hysterectomy, resulting in bladder perforation, permanent urinary incontinence, personal injuries and loss of consortium. We acknowledged that the injury occurred as a result of the hysterectomy, but that it was a recognized complication of the procedure. We also argued that the location of the bladder injury was not the cause of the patient's incontinence, based on the location of the perforation. We successfully argued to the jury that the patient experienced a known and recognized complication of a total abdominal hysterectomy.
