Real Estate Agents Update: Amendments to Retail Shop Leasing Laws delayed

The commencement of the amendments to the retail shop leasing laws in WA has now been delayed until later in 2012.

As many of you will be aware, the Commercial Tenancy (Retail Shops) Agreements Amendment Act 2011 was assented to late last year. The amendment Act had an anticipated effective date of early 2012 but this has now been delayed with the amendments anticipated to take effect in the third quarter of 2012.

The Regulations to the Act remain in the drafting process but we expect them to be made publicly available shortly.

We will provide a further update on the effect of the Regulations once they become available but in the meantime further information regarding the amendments to the Act are contained in our previous update in January 2012.
