On Saturday, October 22, 2022, Lewis Rice member Mark D. Eisemann, Pamela Westhoff of Sheppard, Mullin, Richtner & Hampton, Sean Dennison or CenterCal Properties, and Kathleen Dempsey Boyle of Eversheds Sutherland (US), presented at the ACREL Annual Meeting in Chicago. The session, titled "Just an Old Fashioned Love Song? Rethinking Common and Highly Negotiated Lease Provisions," addressed how the COVID-19 pandemic created an historical shift in the real estate landscape. Sudden closures of office buildings and retail stores required leasing lawyers to take a fresh look at longstanding lease language, winnowing and sifting through perhaps stagnant provisions to attempt to apply the language to new realities. Mark's section delved deeper into redevelopment issues, encouraging real estate professionals to think about and embrace accelerating change by building in flexibility in leases and addressing exit strategies upfront.
