The decision in a recent case before the Monaco Court has caused practitioners to reconsider the effect of Monaco's laws of succession on foreign nationals domiciled in Monaco. This article examines this decision and the influence of Law 214 on the use of trusts.
One important consequence is that a trust established in compliance with Law 214 takes effect regardless of the considerations of Monaco public policy.
